Identity Theft Enforcement and Restitution Act

Definition:

The Identity Theft Enforcement and Restitution Act is pending legislation that would increase the scope of what constitutes identity theft and allows identity theft victims to recoup more of the costs associated with having your identity stolen.

Once passed, the legislation will lower the bar for what is considered punishable identity theft crimes. For example, the bill makes it a felony to use a computer to damage 10 or more other computers, and it makes it possible for law enforcement agencies to prosecute hackers caught stealing personal information in the same state.

Additionally, the bill will allow identity theft victims to recover the costs indirectly associated with identity such as lost salaries due to time taken off work to deal with identity theft damages and money spent to restore credit and identity issues.
